Terms of Service

1. Acceptance of Terms

By accessing or using the AgenticPost website and newsletter service (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and AgenticPost.

2. Description of Service

AgenticPost is an AI-curated newsletter for developers and technical founders building with AI agents. Our content pipeline — including ingestion, curation, writing, and delivery — is powered by artificial intelligence. The Service is offered in two tiers:

  • Free tier: a weekly newsletter edition delivered to your email inbox at no charge.
  • Pro tier: daily newsletter editions with additional deep-dive content, delivered to your email inbox for a recurring subscription fee.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable prior notice where practicable.

3. AI-Generated Content Disclosure

A substantial portion of the content delivered through the Service is generated, curated, or summarised using artificial intelligence models, including large language models provided by Anthropic, PBC. While we strive for accuracy and quality, AI-generated content may contain errors, omissions, or inaccuracies. You acknowledge and agree that:

  • AI-generated content is provided for informational purposes only and does not constitute professional, legal, financial, or technical advice.
  • You should independently verify any information before relying on it for decision-making purposes.
  • AgenticPost does not guarantee the completeness, reliability, or timeliness of AI-generated content.

4. Subscription Terms

4.1 Free Tier

The free tier provides access to a weekly newsletter edition. No payment is required. AgenticPost reserves the right to modify the scope, frequency, or content of the free tier at any time.

4.2 Pro Tier

The Pro tier is offered at a subscription price of EUR 7.00 per month, inclusive of applicable VAT. By subscribing to the Pro tier, you authorise us to charge the applicable subscription fee to your chosen payment method on a recurring monthly basis.

4.3 Auto-Renewal

Pro tier subscriptions automatically renew at the end of each billing period unless cancelled by you prior to the renewal date. You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Upon cancellation, you will continue to receive the Service until the end of your current billing period.

5. Payment Terms

All payments are processed securely by Stripe, Inc. By providing your payment information, you represent and warrant that you are authorised to use the payment method provided. All prices are stated in Euros (EUR) and include applicable VAT.

Refund policy: you may request a full refund within 30 days of any payment. After 30 days, no refunds will be issued. Refund requests should be directed to [email protected].

6. Prohibited Uses

You agree not to use the Service to:

  • violate any applicable local, national, or international law or regulation;
  • redistribute, resell, or republish newsletter content in whole or in substantial part without prior written consent from AgenticPost;
  • use automated means (bots, scrapers, or similar tools) to access the Service in a manner that exceeds normal usage patterns or places undue load on our infrastructure;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • interfere with or disrupt the integrity or performance of the Service or its underlying systems.

7. Intellectual Property

All content delivered through the Service, including AI-generated text, curated summaries, editorial commentary, logos, and branding, is the property of AgenticPost or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and read the newsletter content for your personal, non-commercial use. You may share individual newsletter editions via the sharing mechanisms we provide, but you may not systematically reproduce or redistribute our content.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AgenticPost does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, AgenticPost and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

In no event shall the total aggregate liability of AgenticPost exceed the greater of (a) the total fees paid by you to AgenticPost in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 50.00.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable Austrian or EU law.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of laws provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Vienna, Austria.

If you are a consumer within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG), this choice of jurisdiction shall not deprive you of the protection afforded by the mandatory provisions of the law of your habitual residence.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to you via email or a prominent notice on our website at least 14 days before they take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
